1 Acceptance of Terms
By accessing or using PhotoGPT ("the Service"), accessible from photogpt.io, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service.
These Terms apply to all visitors, users, and others who access or use the Service.
2 Description of Service
PhotoGPT provides AI-powered tools for image editing, generation, and enhancement. Our features include, but are not limited to:
- AI Headshot Generator
- AI Clothes Changer
- AI Hairstyle Changer
- Image Enhancement Tools
Note on AI: The Service uses artificial intelligence algorithms. Due to the probabilistic nature of AI, we cannot guarantee that the results will always be 100% accurate, realistic, or meet your specific expectations every single time.
3 User Accounts & Credits
- Registration: You may need to register an account via Google or Email to access certain features. You are responsible for safeguarding your account credentials.
- Credits System: PhotoGPT operates on a virtual credit system. Credits are required to generate or edit images.
- No Refunds: Credits purchased are generally non-refundable. They are virtual goods with no monetary value outside the Service.
4. Prohibited Usage & Content
We have a zero-tolerance policy for illegal or harmful content. You agree NOT to use PhotoGPT to upload, edit, or generate:
- Child Sexual Abuse Material (CSAM): We automatically report any CSAM content to relevant authorities (NCMEC).
- Non-Consensual Deepfakes: Content that depicts real people in sexual or compromising situations without their consent.
- Hate Speech & Violence: Content promoting violence, discrimination, or illegal acts.
- Infringing Content: Content that violates the copyright or privacy rights of others.
Violation of these policies will result in immediate account ban without refund.
5 Intellectual Property
Your Content
You retain ownership of the images you upload ("Input") and the images generated for you ("Output"). You grant us a license solely to process your images to provide the service.
Our IP
The PhotoGPT platform, code, algorithms, logo, and design are owned by us and protected by copyright laws. You may not reverse engineer our AI models.
6 Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. The quality of AI-generated images depends on the quality of input images and the capabilities of the AI models.
7 Limitation of Liability
In no event shall PhotoGPT be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of the Service.
8 Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
